TERMS OF SERVICE

By making a reservation with Road Torch Car Rentals, LLC ("Road Torch," "we," or "us"), you agree to these Terms of Service and our Rental Agreement. If you do not agree to these terms, you may not book or rent a vehicle through our platform.

The renter must be 21 years of age or older to rent a vehicle from Road Torch Car Rentals. Valid government-issued identification confirming the renter's age will be required at the time of pickup. Reservations made by or on behalf of individuals under 21 will be cancelled.

Up to three (3) additional authorized drivers may be added to a reservation. All authorized drivers must be 21 years of age or older and must obtain and maintain valid personal auto insurance for the full duration of the rental period. Authorized drivers must be listed on the Rental Agreement at or before the time of pickup; any unlisted individual who operates the vehicle is in breach of the Agreement.

Every reservation constitutes a rental agreement between you and Road Torch Car Rentals. Prior to vehicle pickup, you must:

• Provide a valid, government-issued driver's license and attest to your legal eligibility to operate a motor vehicle.
• Provide proof of personal auto insurance or purchase rental coverage through a third-party provider such as Bonzah.
• Attest that all information provided is accurate and understand it will be verified by a third-party platform. Fraudulent or fictitious information will result in cancellation.
• Sign the rental agreement electronically before taking possession of the vehicle.

• Reservation total: Includes the daily rate multiplied by the number of rental days, plus 8.25% Texas sales tax. The rental balance is charged online via Stripe at the time of booking confirmation.
• Security deposit: A security deposit of $100 per day will be charged, not to exceed $500 for the rental period, at the company's discretion based on rental duration and rental history. The deposit is processed as a pre-authorization hold through Stripe for the duration of the rental period and will be returned based on vehicle condition and fulfillment of the Rental Agreement. The timeframe for the deposit to be returned once processed depends on the specific bank processing times and the type of card used for the hold. The hold covers potential damages, theft, mileage overages, refueling, tolls, and administrative fees.
• Payment processor: Online rental payments are processed securely by Stripe. You will be redirected to Stripe's checkout page to enter your card details; Road Torch Car Rentals does not store your card information.
• Name match: The name on the payment card must match the name on the booking.
• Promo codes: Discounts applied via valid promo or referral codes are deducted from the reservation subtotal before tax.
• Rates not prorated: Rental rates are not prorated. The full daily rate applies for each day or any portion of a day that the vehicle is in your possession. No refunds or credits are issued for unused or partial days except as expressly provided in the Cancellation & Early Return Policy.

• 24+ hours before pickup: Full refund, no cancellation fee.
• Within 24 hours of pickup: 50% refund of reservation cost.
• Early return: No refund for unused rental days unless Road Torch Car Rentals is responsible for the early termination.
• Refund processing: Approved refunds are issued to your original payment method through Stripe. Depending on your bank or card issuer, refunds typically appear on your card statement within 5–10 business days.
• To cancel, contact Road Torch Car Rentals directly at admin@roadtorchcarrentals.com.

After your booking is confirmed, you may modify your reservation dates, times, and pickup/return locations through the Customer Portal or Loyalty Account, subject to the following:

• 24-hour deadline: Modifications must be made at least 24 hours before your scheduled pickup date and time. No modifications are allowed within 24 hours of pickup.
• Price adjustments: If the new dates result in a longer or shorter rental, the total price will be recalculated at the original daily rate. Additional charges apply for extra days; refunds for fewer days are subject to the Cancellation & Early Return Policy.
• Vehicle availability: Modifications are subject to vehicle availability for the new dates.

As the renter, you are responsible for:

• Operating the vehicle in accordance with all Texas traffic laws and regulations.
• Returning the vehicle in the same condition as received, accounting for normal wear and tear.
• Refueling the vehicle before return; refueling charges apply if not done.
• Paying any applicable contract violation fees (smoking, pet damage, lost keys, mileage overages, tolls, etc.) as outlined in the fee schedule available in the Track Booking portal.
• Ensuring child safety seats and mobility devices comply with Texas Transportation Code requirements when applicable.

Travel to Texas border cities and/or out of state in a Road Torch Car Rentals vehicle is reserved for well-established and vetted customers ONLY and requires pre-approval from Road Torch Car Rentals. Unauthorized travel to these areas is a breach of the Rental Agreement and may result in additional fees, vehicle recovery, and placement on our Do Not Rent list. If your trip may cross these boundaries, contact us in advance to submit an Out-of-State Travel Request.

If Road Torch Car Rentals is required to perform a forced recovery of the vehicle due to a breach or violation of the Rental Agreement — including but not limited to unauthorized out-of-state travel, failure to return the vehicle, or other contract violations — Road Torch Car Rentals is not responsible for any travel arrangements, accommodations, or transportation costs for the renter or any occupants. The renter is solely responsible for their own return transportation and any associated costs resulting from the forced recovery.

All Road Torch Car Rentals vehicles are equipped with GPS tracking and anti-theft devices to protect our company assets. By renting a vehicle, you acknowledge and consent to the use of these devices during your rental period.

Data obtained from these devices — including vehicle location, speed, and diagnostic information — is securely stored and used solely for the following purposes:

• Locating and recovering vehicles in the event of theft, unauthorized use, or breach of the Rental Agreement.
• Enforcing rental location and travel restrictions.
• Supporting roadside assistance and vehicle diagnostics.
• Resolving disputes related to vehicle use, mileage, or damage.

GPS and anti-theft data is not used to monitor your personal behavior and is retained only for as long as necessary for the purposes described above. For details on how this data is protected, see our Privacy Policy.

You are responsible for any damage to the vehicle, third-party property, or persons arising during your rental period. Road Torch recommends maintaining adequate personal auto insurance coverage. If you do not have personal auto insurance, you may purchase rental coverage through Bonzah or another third-party provider before pickup.

These Terms of Service and all rental agreements are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas, unless otherwise required by law.
